Welcome to Palmer Group (“we,” “us,” or “our”). These Terms of Use (the “Terms”) govern your access to and use of the www.thepalmergroup.com, including any content, functionality, services, job listings, employer/recruiting tools, resources, or communications available through the Site (collectively, the “Services”).
By accessing or using the Services, you agree to these Terms and to our Privacy Policy. If you do not agree to these Terms, do not use the Services.
1. Eligibility & Account Responsibilities
By using this site, you affirm that you are of legal age, have the legal capacity, and legal authority to enter into this Agreement as an individual or on behalf of, or for the benefit of, any corporation, partnership, or other entity with which you are associated.
2. Acceptable Use
You agree not to misuse the Services or help anyone else do so. Prohibited behavior includes attempting to interfere with or disrupt the integrity or performance of the Services, reverse engineering, unauthorized scraping, automated access outside our published APIs, or violating applicable laws and regulations.
3. Intellectual Property
The Services and all content therein, including text, graphics, logos, and software, are owned by Palmer Group or our licensors and are protected by intellectual property laws. You may not use our marks, trade dress, or content without our prior written consent.
4. Third Party Links & Services
The Services may link to third party sites or services. We do not control and are not responsible for third party content, policies, or practices. Your use of third party services is at your own risk.
5. International Use
We control and operate the Site from the United States. We make no representation that the Site is appropriate or available for use in other locations. Accessing the Site from territories where its content is illegal is prohibited.
6. Personal Data
Mobile information will not be shared with third parties/affiliates for marketing/promotional purposes. All the above categories exclude text messaging origin at or opt-in data and consent; this information will not be shared with any third parties.
7. A2P/10DLC SMS (“Texting”) Program Terms
We may offer onetime or recurring informational, customer care, and/or marketing text messages (“Texts”) via application-to-person (A2P) messaging on 10digit long codes (10DLC). 7.1 Program Description & Sender Identification
By enrolling in our Texts, you agree to receive messages from Palmer Group at the mobile number you provide. Message types may include [job alerts/interview reminders/account security notices/marketing offers/timecard reminders/general correspondence]. We identify ourselves in our messages where practical and do not enroll you in multiple programs from a single consent.
7.2 Opt In & Consent
• Express Consent Required: You must provide clear, affirmative consent to receive Texts from us (e.g., checking an unchecked box on a web form next to required disclosures, texting a keyword to our number, or signing a paper/electronic form). For recurring programs, we send a confirmation message after opt in.
• No Condition of Purchase: Your consent to receive Texts is not a condition of purchasing any goods or services.
7.3 Required Disclosures at Opt In
Our calls to action will clearly disclose: (i) program/brand name; (ii) the nature of the program; (iii) “Msg & Data rates may apply”; (iv) message frequency (e.g., “Message frequency varies”); (v) STOP instructions; (vi) contact compliance; and (vii) links to these Terms and our Privacy Policy. Avoid pop ups for these disclosures.
7.4 Opt Out (STOP) & Help Keywords
- You may opt out at any time by replying STOP. We will send a final confirmation Text and cease further messages to that number, unless you subsequently opt back in.

7.5 Message Frequency; Charges
Message frequency varies by program and user activity (e.g., alerts upon triggers). Message and data rates may apply from your mobile carrier. We are not responsible for delays or failures in delivery caused by carriers or mobile providers.
7.6 Supported Carriers; Delivery
Delivery of Texts is subject to your carrier’s capabilities and coverage. Major U.S. carriers enforce 10DLC policies; unregistered or non compliant traffic may be filtered or blocked by carriers. We operate on registered A2P 10DLC campaigns and follow carrier codes of conduct.
7.7 Prohibited & Restricted Content
We prohibit unlawful, deceptive, or harmful content and adhere to CTIA/carrier restrictions (e.g., SHAFT categories—sex, hate, alcohol, firearms, tobacco, along with phishing/smishing, scams, or illicit content). Violations can trigger carrier blocking and significant fines; we reserve the right to suspend messaging to maintain compliance.
7.8 Data Practices
We maintain and conspicuously display an easy to understand Privacy Policy describing what personal information we collect for our Texts, how we use it, and how we secure it, consistent with CTIA privacy guidance. See our

8. Registration & Compliance (Industry Disclosures)
Where applicable, we register our brand and campaigns with The Campaign Registry (TCR) for A2P 10DLC and comply with wireless provider rules. U.S. carriers began strictly blocking unregistered 10DLC traffic and enforcing content/consent rules; we maintain single sender consent records and avoid prohibited traffic evasion practices (e.g., number “snowshoeing”).
9. Disclaimer of Warranties
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON INFRINGEMENT.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TPG AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR REVENUE, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICES OR TEXTS.
11. Indemnification
You agree to defend, indemnify, and hold harmless Palmer Group and its affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use of the Services; (b) your violation of these Terms; or (c) your violation of applicable laws.
12. Changes to the Services or Terms
We may update the Services and these Terms from time to time. If we make material changes, we will post the updated Terms with a new “Last Updated” date and, where required, provide additional notice. Your continued use of the Services after changes become effective constitutes acceptance.
13. Suspension & Termination
We may suspend or terminate your access to the Site or Services (including account access) at any time, with or without notice, for any reason or no reason, including if we reasonably believe you have violated these Terms. Upon termination, the license granted to you terminates immediately. Sections that by their nature should survive (e.g., intellectual property, disclaimers, limitations of liability, indemnity, and dispute resolution) will survive termination.
14. Compliance; Export; Anti-Corruption
You agree to comply with all applicable laws, including employment, anti-discrimination, data protection, export control, and anti-corruption laws. You represent that you are not located in, under the control of, or a national/resident of any country or person on any U.S. sanctions list.
15. Electronic Communications & Consent to Do Business Electronically
By using the Site or Services, you consent to receiving communications from us electronically (e.g., via email, Text, Site notices). You agree electronic communications satisfy any legal requirements for written communications, to the extent permitted by law.
16. Governing Law; Dispute Resolution
These Terms are governed by the laws of the State of Iowa, without regard to conflicts of law principles. Any dispute arising from or relating to these Terms or the Services will be resolved in the state or federal courts located in Polk County, and you consent to the jurisdiction of such courts.
17. Online Time Reporting And Approval System
The Online Time Reporting and Approval System is an online tool that allows Palmer Group’s employees, independent contractors, and business clients to enter, review, submit, and approve time reports through the Sites or via email (the “System”). “Employee” refers to users of the System who are employed by Palmer Group. The term “Independent Contractor” refers to users of the System who are working as independent contractors through Palmer Group. Within this section titled, “ONLINE TIME REPORTING AND APPROVAL SYSTEM,” the term “Customer” refers to users of the System who are business clients of Palmer Group. If you are not an authorized Employee, Independent Contractor, or Customer in the United States, please do not use the System. Unauthorized access or usage is strictly prohibited, and violators are subject to civil liabilities and criminal prosecution.
If you are an Employee or Independent Contractor, you may receive payment of wages using a variety of methods including direct deposit. You may also update your direct deposit information or enter new direct deposit information. You may make changes to your default payment method in the App by going to the Account Information section of the My Account menu. You are responsible for maintaining the accuracy of information about your payment method(s) we have on file (“Payment Method Information”), and you consent to Palmer Group updating such stored information from time-to-time based on information provided by you, your bank, or other payment services providers. You will only provide to us Payment Method Information that you are authorized to use. Your bank may charge you a fee for using direct deposit, which you are solely responsible for.
After a user creates an account in the System and a job order is created, Employees and Independent Contractors may opt to enter the days and hours worked on a time report through the System. A Customer may opt to receive, review, and approve the time report in the System.
17.1 Employee and Contractor Data Entry
If you are an Employee or Independent Contractor, you certify that the days, hours, and any other required information entered on the time report through the System are correct, complete, and were worked by you. You understand that a misstatement of fact may cause you to lose your employment or contract with Palmer Group or may result in removal of your account from the System.
17.2 Customer Data Entry
If you are a Customer, by clicking the submit button, signing the time report, or otherwise approving the time report in writing, you acknowledge your receipt and approval of the time report. You understand that a misstatement of fact may cause Palmer Group to discontinue providing services or may result in removal of your account from the System.
17.3 General Data Entry Terms
By submitting your hours, comments, data, and/or approval of time report information to the System (the “Time Report Information”) and by submitting Payment Method Information to Palmer Group, you hereby grant Palmer Group a perpetual, non-exclusive, irrevocable, royalty free, worldwide license, and right to use, copy, modify, display, distribute, download, store, reproduce, transmit, publish, transfer, adapt, and create derivative works in any manner, by any means, in entirety or a portion of, of your Payment Method Information and Time Report Information.
You acknowledge and accept that Palmer Group will share the Payment Method Information and Time Report Information with third parties for Palmer Group’s business purposes, including but not limited to Palmer Group’s business clients, advisors, agents, and consultants. Palmer Group will not sell your Time Report Information to any third party for marketing purposes.
You are responsible for the security of your password and for any use of your account of the System. You shall promptly notify Palmer Group of any unauthorized use of your password or account.
